These terms and condition of the company Gh Real Estate s.r.o, with registered address Smrčkova 2485/4, Libeň, 180 00 Prague 8, Czech Republic, Id. no. 291 39 643, recorded in the Commercial Register maintained by the Municipal Court in Prague, Section C, Inlay 203127 as an operator of the webpage www.getberg.cz (hereinafter only as the “Operator”) contain the information on the personal data processing regarding the personal data that are entered and processed namely in connection with the service of placing a query by the user of the webpage of the Operator with which the user requests information regarding the offer of the Operator (hereinafter only as the “User”). The webpage and the offers of the Operator placed there are not directed to the persons younger than 18 years. The Operator declares that the personal data are collected and are treated in accordance with the rules determined below and in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) as amended (hereinafter only as the “Regulation”). Personal Data Personal data mean the information that is able to identify the User unambiguously, such as the name and surname, telephone number or an e-mail address, IP address etc. The Operator gathers the personal data that are given to him by the User deliberately only, such as the data given by the User when the user fills in the contact form placed on the webpage of the Operator. Automatically Recorded Information When accessing the webpage of the Operator, the non-personal data are recorded automatically – the type of the web browser, the number of visits, the average time spent on the page, the number of pages visited; this information not being the personal data. Based on this information, aggregated anonymized statistical lists are created and this information is used to track the traffic on the Operator’s webpage and through them. The Operator seeks to improve the content and functionality of the webpage. The statistics lists do not contain personal data enabling the identification of individual Users. The Purpose of Personal Data Processing The primary purpose of personal data processing is to answer the User’s query or solving his request; in this case the personal data are retained by the Operator for the period necessary to execute the User’s query according to the nature of the particular query. Personal data processing does not involve automated decision making or profiling. In the event of the conclusion of a contract between the Operator and the User, the personal data will be used for the purposes of performing these contracts (especially the reservation contract, the future purchase agreement and purchase agreement or the ownership transfer agreement regarding a unit) and will be kept for the duration of these contractual relationships and subsequently for 5 (five) years unless the longer preservation period is required by law; in this case the legal basis for processing is an agreement and the provision of personal data constitutes a contractual requirement. In such a case, the legal basis for the processing of personal data will be the agreement concluded.
If the User expresses his/her consent, his/her personal data will also be used for business and marketing communication purposes for the duration of his/her interest in sending business communication. In this case, the legal basis for the processing of personal data will be the User’s consent. The legal basis for personal data processing is also the legitimate interests of the Operator (mainly for the purposes of keeping records on the contractual relationships and statistical purposes, in order to protect the rights of the Operator against illegal activities, including IT security, recovery of receivables of the Operator) and fulfilment of legal requirements (especially compliance with the requirements under the personal data protection regulation, accounting, fulfilment of obligations according to tax regulation).
